These Terms of Service (“Terms”) govern your use of the Bed Brigade website, submission of a bed request, participation in volunteer activities, donation of funds or materials, and use of any other services offered by Bed Brigade.

Please read these Terms carefully. By accessing or using this website, submitting information through it, requesting a bed, registering to volunteer, making a donation, or otherwise participating in Bed Brigade’s programs, you acknowledge that you have read, understood, and agreed to these Terms.

If you do not agree to these Terms, please do not use the website or submit information through it.

1. About Bed Brigade

Bed Brigade, Inc. is an Ohio nonprofit corporation recognized as tax-exempt under Section 501(c)(3) of the Internal Revenue Code. Its federal employer identification number is 87-4756942.

Bed Brigade is a Christian volunteer organization that builds and delivers beds to children and families in need.

In these Terms:

• “Bed Brigade,” “we,” “us,” and “our” refer to Bed Brigade, Inc. and, where applicable, the Bed Brigade chapter or participating organization providing the relevant service.
• “You” and “your” refer to any person who visits the website, submits a request, receives a bed, volunteers, donates, or otherwise participates in a Bed Brigade program.
• “Bed Brigade Parties” means Bed Brigade, Inc., participating chapters and organizations, and their respective directors, officers, employees, volunteers, agents, and representatives.

Some Bed Brigade chapters or participating organizations may be operated by separate legal entities. Additional chapter-specific policies, waivers, or requirements may apply to particular activities.

2. Eligibility and Authority

You must be at least 18 years old to submit a bed request, register independently as a volunteer, make legally binding representations through the website, or otherwise agree to these Terms.

When submitting a request for a child, you represent that you are:

1. the child’s parent or legal guardian;
2. a person authorized by the child’s parent or legal guardian; or
3. an authorized representative of an organization assisting the family.

If you provide information on behalf of another person, you represent that you have permission to provide that information and to communicate with Bed Brigade on that person’s behalf.

3. Beds Are Charitable Gifts

Beds provided through Bed Brigade are charitable gifts. They are not purchased goods or services.

There is generally no charge to receive a bed, and Bed Brigade does not ordinarily require proof of income. However, the submission or acceptance of a request does not create:

• a contract for the delivery of a bed;
• an entitlement or legal right to receive a bed;
• a guarantee that a request will be approved;
• a promise that a bed will be available by a particular date; or
• an obligation for Bed Brigade to continue processing or fulfilling a request.

The ability to provide beds depends on available funding, donated materials, volunteers, scheduling, geographic service areas, program capacity, safety considerations, and other operational limitations.

Bed Brigade may approve, decline, place on hold, refer, cancel, or discontinue a request at any time when reasonably necessary to administer its charitable programs, protect the safety of families or volunteers, prevent misuse, or comply with applicable law.

4. Bed Requests and Accurate Information

You agree to provide information that is complete and accurate to the best of your knowledge.

You may request a bed only for a person who genuinely needs one. Beds are intended for the individuals identified in the approved request and may not be sold, exchanged, used for commercial purposes, or knowingly transferred to another person without first contacting Bed Brigade.

Bed Brigade may decline or cancel a request when it reasonably believes that:

• information provided in the request is materially false, incomplete, or misleading;
• the request duplicates another pending or fulfilled request;
• the requested recipient is outside the applicable service area;
• the request is inconsistent with Bed Brigade’s charitable mission or eligibility guidelines;
• fulfillment could create an unreasonable safety risk;
• a recipient, household member, or other person has threatened, harassed, or acted inappropriately toward a volunteer or representative;
• the program is being misused; or
• Bed Brigade lacks the resources necessary to fulfill the request.

Bed Brigade may contact applicants, referral organizations, parents, guardians, or other authorized persons to clarify information and coordinate service.

5. Delivery and Installation

Unless alternative arrangements are expressly approved, Bed Brigade volunteers will deliver and assemble the bed at the approved residence.

You agree to provide:

• an adult who is at least 18 years old and authorized to permit entry;
• safe and reasonably clear access to the residence and the room where the bed will be placed;
• sufficient space for the bed to be safely assembled and used;
• accurate delivery information and reasonable notice of scheduling conflicts; and
• an environment free from conditions that create an unreasonable risk to volunteers.

Examples of unsafe conditions may include threatening behavior, uncontrolled animals, exposed hazardous materials, unsafe structural conditions, active criminal activity, severe infestation, inaccessible work areas, or other circumstances that make entry or assembly unsafe.

Delivery crews may, in their reasonable judgment:

• decline to enter a residence;
• stop work;
• leave a bed or materials unassembled when doing so is reasonably safe;
• require that unsafe conditions be corrected;
• reschedule the delivery; or
• cancel the delivery.

Bed Brigade is not responsible for delays or unsuccessful delivery resulting from inaccurate information, the absence of an authorized adult, unsafe conditions, inadequate space, inability to access the residence, or circumstances outside Bed Brigade’s reasonable control.

Except when expressly agreed in advance, volunteers are not responsible for moving existing furniture, removing old mattresses or bed frames, performing home repairs, or modifying the residence.

6. Bed Condition, Use, and Maintenance

Beds are constructed and assembled by volunteers using purchased or donated materials. To the fullest extent permitted by applicable law, each bed is provided “as is” and “as available,” without express or implied warranties, including implied warranties of merchantability, fitness for a particular purpose, durability, or noninfringement.

Once delivery and installation are complete, the recipient or responsible adult assumes responsibility for the bed’s proper use, inspection, maintenance, placement, and condition.

You agree to:

• follow all safety and use instructions provided by Bed Brigade;
• use an appropriately sized mattress and bedding;
• periodically inspect the bed, fasteners, guardrails, ladder, slats, and supporting components;
• stop using the bed immediately if it becomes loose, unstable, damaged, or unsafe;
• prevent jumping, climbing, hanging, or other unintended use;
• contact Bed Brigade promptly if you identify a possible construction or installation issue; and
• obtain appropriate assistance before moving, disassembling, reassembling, or modifying the bed.

Moving or modifying a bed may affect its stability. Bed Brigade is not responsible for damage or injury resulting from improper use, neglect, unauthorized modification, relocation, disassembly, reassembly, unsuitable mattresses, missing components, or failure to follow safety instructions.

Nothing in this section excludes any warranty, duty, or responsibility that cannot lawfully be excluded.

7. Bunk-Bed Safety

Bunk beds require special precautions.

A child under six years of age must never use the upper bunk.

You further agree that:

• all guardrails, ladders, slats, fasteners, warning labels, and safety components must remain properly installed and in use;
• only an appropriately sized mattress may be used;
• the top surface of the mattress must remain below the maximum mattress-height marking or other specified safety limit;
• the bunk bed must not be placed near ceiling fans, light fixtures, cords, windows, or other hazards;
• children must not attach ropes, belts, cords, hooks, or similar items to the bed; and
• use of the upper bunk must stop immediately if any guardrail, ladder, fastener, support, or structural component becomes loose, damaged, or missing.

These requirements are mandatory safety conditions and may not be waived by a parent, guardian, recipient, volunteer, or chapter representative.

8. Volunteer Participation

Volunteer activities may involve power tools, hand tools, lumber, sawdust, lifting, loading, transportation, construction activities, and entry into private residences. These activities may involve known and unknown risks of personal injury, property damage, or other loss.

By participating, you agree to:

• follow all safety rules, training, supervision, and instructions;
• use required protective equipment;
• perform only tasks for which you are physically able, appropriately trained, and authorized;
• promptly report unsafe conditions, injuries, or damaged equipment;
• treat recipient families, other volunteers, and Bed Brigade representatives respectfully;
• protect confidential or sensitive information encountered through volunteering;
• refrain from photographing, recording, or sharing information about recipient families without authorization; and
• avoid participating while impaired by alcohol, illegal drugs, or any condition that would make participation unsafe.

To the fullest extent permitted by law, you knowingly and voluntarily assume the ordinary and inherent risks associated with the volunteer activities in which you choose to participate.

Certain activities may require a separate volunteer agreement, release, background check, driver qualification, parental consent, confidentiality agreement, or other documentation. If a separate agreement conflicts with these Terms, the separate agreement will control with respect to the activity it covers.

Volunteers under 18 may participate only in age-appropriate activities and with the consent and supervision required by the applicable chapter. Bed Brigade may limit the use of tools, entry into recipient homes, driving, lifting, or other activities based on age, training, or safety considerations.

Bed Brigade may restrict, suspend, or end a person’s volunteer participation at any time when it reasonably determines that doing so is in the best interests of the organization, its volunteers, or the families it serves.

9. Photography and Publicity

Bed Brigade may request permission to photograph, film, or otherwise record volunteer activities. Any separate photo or media release will govern Bed Brigade’s use of an identifiable person’s image, voice, or likeness.

Unless photography is necessary for documenting an incident or protecting safety, declining an optional photo or media release will not prevent a person from participating in ordinary volunteer activities.

Volunteers may not photograph or record children, recipient families, homes, personal documents, addresses, or identifying information without express authorization from Bed Brigade and, where applicable, the parent, guardian, or affected individual.

10. Donations

Donations are voluntary and are generally nonrefundable. Bed Brigade may consider a refund request made promptly after a mistaken or unauthorized donation, but refunds remain subject to applicable law, payment-processor rules, and the circumstances of the donation.

Contributions may be tax-deductible to the extent permitted by law. Bed Brigade does not provide individual tax, legal, or financial advice, and donors are responsible for determining the tax treatment of their contributions.

Unless otherwise stated:

• a donation designated for a local chapter will support the charitable work of that chapter or service area;
• an unrestricted donation may be used where Bed Brigade determines the need is greatest; and
• Bed Brigade retains control and discretion over contributed funds as required for charitable gifts.

Bed Brigade will make reasonable efforts to honor an accepted written restriction on a donation. If the restricted purpose becomes unlawful, impracticable, impossible to fulfill, or inconsistent with Bed Brigade’s charitable mission, Bed Brigade may contact the donor when reasonably possible and may use the contribution for a substantially similar charitable purpose, subject to applicable law.

Bed Brigade may decline or return a donation that:

• is inconsistent with its mission or values;
• carries an unacceptable restriction or obligation;
• may create legal, financial, reputational, or operational risk;
• is suspected to result from fraud or unauthorized activity; or
• cannot reasonably be accepted or administered.

Online payments are processed by third-party payment providers. Your use of those services may also be governed by the provider’s terms and privacy practices.

11. Text Messages and Telephone Communications

When you provide a telephone number and affirmatively consent to receive text messages, Bed Brigade may send messages related to your request, delivery, volunteer activity, donation, or other interaction with the organization.

Message frequency may vary. Message and data rates may apply.

Consent to receive text messages is not a condition of receiving a bed, making a donation, or volunteering, except when text messaging is reasonably necessary to provide a specific optional communication service you request.

You may withdraw consent by replying STOP or by using another reasonable opt-out method identified in the message or applicable text-message program terms. Bed Brigade may send one final message confirming the opt-out. For assistance, reply HELP or contact Bed Brigade using the information below.

Additional terms may appear on Bed Brigade’s text-message program page. Information collected through the program will be handled in accordance with the Bed Brigade Privacy Policy.

12. Privacy and Sensitive Information

Your use of the website is also subject to the Bed Brigade Privacy Policy, which explains how personal information is collected, used, stored, and disclosed. The Privacy Policy is incorporated into these Terms by reference.

You agree not to submit sensitive personal information unless it is reasonably requested and necessary for the applicable Bed Brigade program.

You may not access, use, disclose, photograph, copy, or distribute another person’s personal information except as authorized by Bed Brigade and permitted by law.

13. Acceptable Use of the Website

You may use the website only for lawful purposes and in accordance with these Terms.

You may not:

• submit a fraudulent, deceptive, or knowingly inaccurate request;
• impersonate another person or misrepresent your authority;
• attempt to gain unauthorized access to an account, record, system, or network;
• access or attempt to access information belonging to another family, donor, volunteer, or user;
• introduce malware, malicious code, or other harmful technology;
• interfere with the operation, security, or availability of the website;
• conduct automated scraping, harvesting, or bulk collection without written permission;
• use the website to harass, threaten, exploit, or harm another person;
• use information obtained through Bed Brigade for solicitation, commercial activity, or an unrelated purpose; or
• violate any applicable law or the rights of another person.

Bed Brigade may restrict or terminate access, preserve relevant information, and report suspected unlawful activity when reasonably necessary.

14. Intellectual Property

The website and its contents—including text, graphics, logos, photographs, videos, designs, forms, software, trademarks, and other materials—are owned by or licensed to Bed Brigade and are protected by applicable intellectual-property laws.

Bed Brigade grants you a limited, revocable, nonexclusive, nontransferable license to access and use the website for personal, charitable, and noncommercial purposes consistent with these Terms.

You may share unmodified Bed Brigade materials to help families locate Bed Brigade or to promote authorized Bed Brigade activities, provided that you do not:

• remove ownership or attribution notices;
• imply an endorsement or affiliation that does not exist;
• modify the material in a misleading way;
• sell or commercially exploit the material; or
• present it as your own work.

No other rights are granted without prior written permission.

15. Third-Party Services and Links

The website may contain links to or integrations with third-party websites, maps, payment processors, communication providers, social-media platforms, or other services.

Bed Brigade does not control and is not responsible for the availability, security, content, terms, or privacy practices of third-party services. A link or integration does not necessarily constitute an endorsement.

Your use of a third-party service is governed by that provider’s terms and policies.

16. Website Availability and Disclaimers

To the fullest extent permitted by applicable law, the website and all information, programs, beds, materials, and services made available through Bed Brigade are provided “as is” and “as available.”

Bed Brigade does not warrant that:

• the website will always be available, secure, uninterrupted, or error-free;
• information on the website will always be complete, current, or free from errors;
• every request will be reviewed or fulfilled within a particular period;
• every chapter will offer the same programs or services; or
• the website will be compatible with every device or system.

Bed Brigade may change, suspend, discontinue, or restrict any part of the website or its programs without prior notice.

Nothing on the website constitutes medical, legal, tax, financial, social-work, child-welfare, construction, or other professional advice.

17. Assumption of Risk

You acknowledge that receiving, assembling, maintaining, moving, and using furniture—and participating in construction, delivery, or volunteer activities—involves risks that cannot be completely eliminated.

To the fullest extent permitted by law, you voluntarily accept the ordinary and reasonably foreseeable risks associated with your participation, except to the extent that a loss is caused by conduct for which liability cannot lawfully be waived or limited.

18. Limitation of Liability

To the fullest extent permitted by applicable law, the Bed Brigade Parties will not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages, including loss of use, loss of data, lost income, or emotional distress, arising from or related to:

• use of or inability to use the website;
• delay, denial, cancellation, or inability to fulfill a bed request;
• volunteer participation;
• use, misuse, modification, relocation, maintenance, or condition of a donated bed;
• acts or omissions of third-party service providers; or
• any other interaction with Bed Brigade.

To the fullest extent permitted by law, the aggregate liability of the Bed Brigade Parties arising from a particular claim will not exceed the greater of:

1. the amount you paid directly to Bed Brigade for the specific service giving rise to the claim; or
2. one hundred dollars ($100).

These limitations apply regardless of the legal theory asserted and even if Bed Brigade was advised that damages were possible.

Some jurisdictions do not allow certain exclusions or limitations of liability. In those jurisdictions, these provisions will apply only to the maximum extent permitted by law.

Nothing in these Terms excludes or limits liability for fraud, willful or intentional misconduct, gross negligence where liability cannot lawfully be limited, or any other liability that applicable law prohibits Bed Brigade from excluding or limiting.

19. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless the Bed Brigade Parties from claims, liabilities, damages, judgments, losses, costs, and reasonable attorneys’ fees arising from or related to:

• your material violation of these Terms;
• your unlawful or unauthorized use of the website;
• information you knowingly submit without authorization;
• your infringement of another person’s rights;
• your intentional misconduct; or
• your unauthorized sale, transfer, modification, relocation, disassembly, reassembly, or misuse of a donated bed.

This provision does not require you to indemnify a Bed Brigade Party for that party’s own negligence or misconduct to the extent such indemnification is prohibited by law.

20. Suspension and Termination

Bed Brigade may suspend, restrict, or terminate your access to the website or participation in a program if it reasonably believes that you have:

• violated these Terms or another applicable policy;
• provided materially false or misleading information;
• created a safety or security risk;
• misused Bed Brigade’s programs or information;
• threatened or harassed another person; or
• engaged in unlawful conduct.

Sections that by their nature should survive termination—including provisions concerning intellectual property, disclaimers, assumption of risk, liability limitations, indemnification, and dispute resolution—will remain in effect.

21. Changes to These Terms

Bed Brigade may revise these Terms periodically to reflect changes in its programs, practices, technology, or legal obligations.

The revised Terms will be posted on the website with an updated effective date. Unless otherwise stated, changes will apply prospectively when posted.

Your continued use of the website or participation in Bed Brigade programs after revised Terms become effective constitutes acceptance of the revised Terms.

Material changes will not retroactively alter rights or obligations arising before the revised Terms became effective when doing so would be prohibited by law.

22. Governing Law and Venue

These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-law principles.

Except where applicable law requires otherwise, any legal proceeding arising from or relating to these Terms, the website, or Bed Brigade’s services must be brought exclusively in a state or federal court having jurisdiction in Franklin County, Ohio. You consent to the personal jurisdiction and venue of those courts.

Before filing a lawsuit, the parties are encouraged to make a good-faith effort to resolve the dispute informally by providing written notice describing the issue and the requested resolution.

23. Severability and Waiver

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the greatest extent permitted by law or modified to reflect its intended purpose as closely as possible. The remaining provisions will remain in effect.

Bed Brigade’s failure to enforce a provision on one occasion does not waive its right to enforce that provision or any other provision later.

24. Entire Agreement

These Terms, together with the Privacy Policy and any applicable program-specific terms, waiver, release, consent form, or written agreement, constitute the entire agreement between you and Bed Brigade concerning the subject matter they address.

If a program-specific written agreement conflicts with these Terms, the program-specific agreement will control with respect to that program or activity.
